Procedure for Red-Circling

Procedure

1.0     Transitioning to the appropriate Salary Range

An employee shall remain Red-Circled until such time as the Salary, exclusive of any adjustment, is equal to or lesser than the maximum step of assigned Salary Range.

An employee shall remain in Red-Circled situation until such time as the existing salary is equal to or lesser than the top step of the assigned pay range. When employees cease to be Red-Circled, they are to be placed at a step on the assigned pay range which is equal to the existing salary or where the existing salary falls between two steps to the higher step. 

2.0    Application of GEI for Red-Circled Employees

In the event of a GEI, Red-Circled employees will receive increases in the form of non-pensionable earnings, payable on regular pay biweekly cheques for 12 months from the date the related increase was effective, so that the amount paid is equivalent to the annual increases. If a subsequent GEI is implemented prior to the end of the 12-month period, a new non-pensionable increase is paid similarly based upon the subsequent GEI.  

3.0    Appointment Changes

If an employee vacates the position, the Red-Circling ceases. Any non-pensionable salary adjustment is removed.

3.1    Promotion, Demotion or Temporary Assignments

A Temporary Assignment, promotion or demotion action for a Red-Circled employee is based upon the Salary for the highest step for the applicable pay scale. It is exclusive of any Red-Circling or GEI adjustments that they are receiving. 

4.0    Overtime

If a Red-Circled employee is eligible for overtime, the overtime rate is calculated based on their base Salary (on scale) and does not take into account any Red-Circled salary adjustment that the employee may be receiving at the time. 

5.0    Market Differential

In cases where a Market Differential has been associated with the position and it is removed, the total earnings including Market Differential amount will be Red-Circled.
