PROCEDURE TO APPEAL A RESEARCH ETHICS BOARD DECISION

  

A decision of a REB to allow or disallow research on ethical grounds can be appealed only on the basis of an error in process.
Investigators wishing to lodge an appeal against a decision of the HIC must submit a letter to the Dean of Medicine, acting for the President of the University.

Investigators wishing to lodge an appeal against a decision of the ICEHR or the SWGCREB must submit a letter of appeal to the Vice-President (Research).

A decision of a REB to allow or disallow research on ethical grounds can be appealed only on the basis of an error in process.

In the case of appeals against a decision of either the ICEHR or the SWGCREB, these two REBs will serve as an Appeals Board for each other. When an appeal has been lodged against a decision of either of these two REBs, the Vice-President (Research) will advise the two REBs that an appeal has been made. The appropriate REB will consider the appeal and the other Board will have no involvement in the appeal process except to be advised of its final disposition.

In the case of appeals against a decision of the HIC, the Dean of Medicine will convene the Appeals Board to hear the appeal. The Appeals Board is a standing committee of the University. The membership of the Appeals Board excludes current members of the HIC. The Dean of Medicine will inform current members of the HIC that an appeal has been made and the outcome of the appeal, but the HIC will have no involvement in the appeals process.
