Controlled Goods

Purpose

To define the authority, obligations and procedures, in accordance with the Controlled Goods Regulations of the Defence Production Act, for the purchase, receipt, registration, storage, security assessment, shipment and use of controlled technology and goods.  See the Controlled Goods Directorate.

Scope

All employees and students who examine, possess or transfer any controlled good or technology for or at Memorial University.

Definitions

Controlled Goods — Those military, strategic and military-related goods and technology, as well as dual-use goods and technology as identified by the Department of Public Works and Government Services Canada as being controlled goods. Items such as military vehicles, certain firearms and related ammunition, military aircraft, military electronics, missiles, satellites and most related components are generally considered to be controlled goods and/or controlled technology.

Designated Official — Person, who subject to approval of a security assessment by the Controlled Goods Directorate, carries out certain duties such as conducting a security assessment of each user of the controlled goods (except temporary workers) who requires in the course of their duties access to controlled goods and/or controlled technology. The Designated Official must be either a Canadian citizen ordinarily resident in Canada or a permanent resident ordinarily resident in Canada

Registered Individual/Person — The name of any person who examines, possesses or transfers controlled goods must be filed with the Controlled Goods Directorate after security assessment by the Designated Official.

University — Memorial University of Newfoundland.

Policy

The University has goods and/or technology in its possession which are identified as controlled goods and therefore subject to the Controlled Goods Regulations of the Defence Production Act.

All individuals identified in the Scope shall comply with this policy and with the Controlled Goods Regulations of the Defence Production Act.

The Radiation and Biosafety Control Officer is assigned the role of the University's Designated Official.

Those wishing to examine, possess or transfer controlled goods are subject to security assessments and reviews and are required to attend training in respect of secure handling of the controlled goods. The Designated Official facilitates and/or conducts both the security assessment and the training.

The University, through the Designated Official, keeps and maintains records of security assessments and supporting documentation in respect of each person who examines, possesses, or transfers controlled goods, in accordance with privacy legislation and the Policies on Information Access and Privacy Protection.

The University, through the Designated Official, keeps and maintains records of description of any controlled good received, transferred and disposed of.

Any known security breach in relation to controlled goods must be reported immediately to Campus Enforcement and Patrol and the Designated Official. The University informs the Controlled Goods Directorate within 72 hours of a security breach.

The University provides briefings in respect of the secure handling of controlled goods by visitors who are authorized to examine these goods.

NON-COMPLIANCE:
Failure to comply with Controlled Goods Regulations or this Policy may result in revocation of registration and/or prosecution as outlined in the Defence Production Act.
